Republican Senators Sign Letter Demanding ATF Withdraw Pistol Brace Ban

Dozens of Republican senators recently signed a letter to Attorney General Merrick Garland demanding that the Biden administration withdraw its recent rule change on how pistol stabilizing braces are classified.

The 48 Republican senators wrote that “the way the proposed rule is written makes clear that the ATF intends to bring the most common uses of the most widely possessed stabilizing braces within the purview of the NFA. Doing so would turn millions of law-abiding Americans into criminals overnight, and would constitute the largest executive branch-imposed gun registration and confiscation scheme in American history.”

The proposed rule change was published June 7, and it would treat certain handguns equipped with a stabilizing brace in the same manner as a short-barreled rifles, requiring them to be regulated under the National Firearms Act (NFA) of 1934.

In order to possess a firearm regulated under the NFA, a person must be fingerprinted, photographed, undergo a background check, pay a $200 federal tax, and then register the firearm with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). To say this process is onerous would be generous, as those who are in violation of it are subject to serious federal penalties.

“It should come as no surprise that the most anti-gun administration in American history would bend (and break) the rules to suit their gun control ends,” reported the NRA Institute for Legislative Action (ILA).

As for stabilizing braces, they are “particularly valuable for differently abled shooters who may not have the use of two hands,” reported NRA-ILA, which also noted the true goal of proposals like this: “banning all firearms.”

Late last year, the ATF proposed similar guidance for these braces, but quickly withdrew it. Of course, the White House is now occupied by an administration that abhors your Second Amendment rights, and the sitting attorney general seems no better. Now, these anti-gun forces are working in concert, once again attempting to ram through their radical gun-control agenda. 

“This is plain wrong. The proposed rule is worse than merely abdicating your responsibility to protect Americans from criminals; you’re threatening to turn law-abiding Americans into criminals by imposing the largest executive branch-initiated gun registration and confiscation program in American history. We urge you to turn back. Correct this mistake and withdraw the proposed rule,” concluded the letter.
