9th Circuit Upholds California Magazine-Ban Injunction

A panel of judges who sit on the 9th Circuit Court of Appeals has sided with law-abiding gun owners by agreeing with a lower court that ruled to suspend enforcement of a recently enacted law that criminalizes people who own magazines that have a capacity of more than 10 rounds.

“This is a significant win for law-abiding gun owners in California,” said Chris W. Cox, executive director of the NRA’s Institute for Legislative Action.

The NRA, in conjunction with the California Rifle and Pistol Association, sought the injunction against the magazine ban, saying it would instantly turn many law-abiding gun owners into criminals.

A lower-level general district court judge agreed and put the kibosh on the ban before it could take effect. California appealed, which led to this week’s Circuit Court ruling. Early predictions are that California will appeal again, asking that the full 9th Circuit address the case.
